Common Prayer: Writ Petitions are filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the respondent herein to receive the application of the petitioner, dated 03.06.2019, in Form CCPA and the prescribed fee for the grant of a Autorickshaw Permit to operate the vehicle within radius of 30 km distance from Mecherry Bus Stand, Salem district and to consider the same.

: Mr.N.Inbanathan Additional Government Pleader COMMON ORDER Heard the learned counsel for the petitioners and the learned Additional Government Pleader for the respondent.

2. The contention of the petitioners is that they have purchased the auto and sought for the grant of permit to run the auto within 30 km radius from Mecherry bus stand. The applications have not been received by the respondent despite the ban of issuing Auto Rickshaw issued in the year 2016 being lifted.

3. The learned Additional Government Pleader appearing for the respondent would submit that the earlier ban imposed under G.O was lifted, However, based on the local needs and road facility, the concerned Regional Transport Officer grant license for autos and public carriers. As far as the Salem District is concerned, the meeting of Regional Transport Authority and the https://hcservices.ecourts.gov.in/hcservices/

Regional Transport Officer was convened on 19.02.2019 and taking note of existing 7033 Auto Rickshaw within the Salem District and the opinion/objections received from the stake holders, they have decided not to issue any permit for Auto Rickshaw upto 31.03.2020. The said decision has been taken pursuant to the power under Rule 165 of Tamil Nadu Motor Vehicles Rules.

4. Taking note of the above facts, the petitioners herein are directed to make their application after expiry of ban period. If any such application made, the respondent shall consider the representation based on the prevailing necessity for grant of permission.

5. With the above observations, these Writ Petitions are dismissed. No costs.
