ORDER
This Criminal Original Petition has been filed seeking a direction to the learned Special Court for Trial of Cases under Scheduled Caste and Scheduled Tribes Prevention of Atrocities Act, Thiruvarur in SPL SC.No.86 of 2025 in connection with Cr.No.125 2016 to accept the surrender petition filed by the petitioner and consider the bail application on the same day.
2. Heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor for respondents 1 and 2 and perused the materials on record.
3. The case of the prosecution is that, in the year 2016, the de facto complainant/third respondent was standing on the road and talking with his friends. At that time, the petitioner along with his friends came in a motorcycle in a rash and negligent manner and dashed against the de facto complainant. When the same was questioned, petitioner and his friends assaulted the de facto complainant with a knife, causing grievous injuries, and also abused him by calling his caste name.
4. It is seen that the charge sheet was originally filed in Spl.S.C. No.61 of 2022 against six accused persons. Since the petitioner and A3 absconded, the case was split up. The original case ended in acquittal. The split up case in Spl.S.C.No.86 of 2025 is now taken up for trial and the petitioner is arrayed as A1.
5. The learned counsel for the petitioner submitted that the petitioner has been falsely implicated in the present case.
6.
In view of the above factual position, there shall be a direction to the Special Court for Trial of Cases under Scheduled Caste and Scheduled Tribes Prevention of Atrocities Act, Thiruvarur to consider the petitioner's bail application, preferably on the same day of his surrender, in connection with Spl.S.C.No.86 of 2025 and to pass appropriate orders in accordance with law, after affording due opportunity to the victims under Section 15-A of the SC/ST (PoA) Act, 1989. The petitioner shall surrender before the jurisdictional Court concerned within a period of fifteen days from the date of the receipt of a copy of this order.
7. The Criminal Original Petition stands disposed of accordingly. 29-04-2026 Index: Yes/No Speaking/Non-speaking order PVS
