This petition is filed to enlarge the petitioner on anticipatory bail in the event of arrest his arrest in connection with in Crime No.203 of 2023 on the file of the respondent, Karumathampatti Police Station, Coimbatore District.
2.It is the submission of learned counsel for the petitioner that petitioner and defacto-complainant lived together for sometime. Thereafter, they broke. During their joint living, they obtained a personal loan. Defactocomplainant is liable to pay her part of the loan amount. When petitioner demanded that amount, this false complaint is given. Thus, he prayed for grant of anticipatory bail.
3.The learned counsel for the defacto-complainant/intervenor submitted that petitioner and defacto-complainant had illicit affair. When that was condemned by petitioner's wife and mother, they broke their relationship. Defacto-complainant left the petitioner and started living with her daughters. On 15.05.2023, at about 1.00 p.m., when defactocomplainant was in her house, petitioner had come to her house, scolded her 1/3
in filthy language and stabbed her on her left chest and back. Then, he made a criminal intimidation.
4.The learned Government Advocate (Criminal side) also supported the case of the defacto-complainant and submitted that the injuries suffered by the defacto-complainant is a grievous injury. 5.Considered the rival submissions and perused the records. 6.Considering the nature of the allegations made against the petitioner that the petitioner visited the defacto-complainant's house and caused her injuries and the injuries are grievous injuries, this Court is not inclined to grant anticipatory bail to the petitioner.
7.Accordingly, this Criminal Original Petition is dismissed. 20.07.2023 ep 2/3
