For the reasons stated in the accompanying affidavit and also considering the fact that the original writ petition was dismissed as abated and the present application is filed by the legal representatives of the deceased sole writ petitioner, this Court is of the considered view that the delay is required to be condoned in the interest of justice. Hence, the delay of 521 days in filing restoration application is condoned.

2. In the light of the above, this Court is also inclined to restore the writ petition for adjudicating the same on merits in the interest of justice.

3. Accordingly, both the writ miscellaneous petitions are ordered and the order dated 26.11.2021 passed in writ petition is re-called and the main writ petition is restored to file.
