Respondent Prayer: Criminal Original petition is filed under Section 482 of Criminal Procedure Code, to direct the respondent herein to preserve the CCTV footage of the respondent's police station on 13.05.2019 between 11.00 a.m. to 12.15 a.m. recording the said attack on the petitioner in Crime No.373 of 2019 in a safe and secure manner.

ORDER

This petition has been filed seeking for a direction to preserve the CCTV footage which recorded the incident that took place on 13.05.2019 between 11.00 a.m. to 12.15 p.m. 2.The learned counsel for the petitioner submitted that the petitioner was attacked by the Sub Inspector of Police, Pattabiram and thereafter, an FIR is pending in Crime No.373 of 2019 in this regard. The recording in the CCTV will be a material evidence to prove the case of the petitioner. Therefore, the petitioner wants CCTV footage to be preserved.

3. The learned Additional Public Prosecutor submitted that there was a case and counter and the incident that is alleged to have taken place on 13.05.2019, has already been taken note of by the higher officials and it will be preserved by the police. https://hcservices.ecourts.gov.in/hcservices/

4. This Criminal Original Petition is disposed of with a direction to the respondent Police to preserve CCTV maintained in the Police Station on 13.05.2019 between 11.00 a.m. and 12.15 p.m. No prejudice will be caused by preserving the footage and it will actually help the Court to come to a final conclusion regarding the incident.

5. This Criminal Original Petition is disposed of with the above direction.
