Mr. A.R. Inayath Respondents Criminal Original Petition filed under Section 482 of the Code of Criminal Procedure to direct the first respondent-Police to conduct an enquiry in C.S.R. dated 28-01-2015 given by the first respondent based on the complaint dated 27-01-2015 given by the petitioner against the second respondent and investigate into the matter in accordance with law.

ORDER

Heard the learned counsel for the petitioner. 2.

Today, the respondent-Police has filed a status report wherein in Paragraph No.4, it is stated as follows: "I further respectfully submit that on 22-04-2015, I have enquired the second respondent about the steps taken by him to measure the piece of land. The second respondent stated that he has already submitted a requisition to the Tahsildar, Alandur to allot a surveyor by paying the requisite amount and he is waiting for the visit of the surveyor. However, the second respondent stated that one suit is pending before the JM Court, Alandur vide OS No.591/2012 in relation to the dispute of this passage where the petitioner attempted to attend the repair work by digging and stated that he is waiting for the verdict of the court and will obey the court verdict. https://hcservices.ecourts.gov.in/hcservices/

The petitioner stated that his application for the survey of the same place was rejected by the Tahsildar as there is no patta in his name. Due to this, he has applied for transfer of patta."

Under such circumstances, the respondent-Police is directed to proceed with the enquiry as undertaken in the status report and take action in accordance with law. With the above directions, the petition is closed.
