ORDER

This Criminal Original Petition has been filed by the petitioner to quash the FIR No.66 of 2025 dated 09.02.2025 on the file of the first respondent police in so far the petitioner is concerned.

2. The case of the petitioners is that the first petitioner is running a Spa in the name and style of Edden Spa in Coimbatore. The petitioners 2 to 7 are his employees. Based on a false complaint given by the second respondent, the first respondent police registered the FIR in Crime No.66 of 2025 against the petitioners for offence under Sections 3(2)(a), 4(2)(c) and 5(1)(d) of Immoral Traffic (Prevention) Act, as if the petitioners under the guise of running spa, indulged in immoral trafficking. Hence, the present petition is filed to quash the FIR registered against the petitioners.

3. The learned counsel for the petitioners submitted that out of jealous, the competitors of the petitioners, in collusion with the defacto complainant lodged a false complaint against the petitioners and that there is no material evidence against the petitioners.

4. Heard the learned counsel for the petitioners and the learned Government Advocate (Crl. Side) appearing for the first respondent police and also perused the materials available on record.

5. Since no adverse order is being passed against the second respondent, notice to the second respondent is dispensed with.

6. A reading of the FIR shows that there are prima facie allegations against the petitioners. The merits of the case can be decided only after completion of investigation and filing of charge sheet and not at this stage. At this stage, the Court cannot go into the merits of the case. Now the investigation is on the way. Therefore, this Court is not inclined to quash the FIR.

7. Accordingly, this Criminal Original Petition is dismissed at the admission stage itself. Consequently, the connected Miscellaneous Petition is closed.
