The Criminal Miscellaneous Petitions have been filed to modify the condition imposed by this Court in Crl.O.P.No.6628 of 2023 dated 17.05.2023 that "the petitioners shall execute a bond for a sum of Rs.10,000/- for each person with two sureties each for a like sum to the satisfaction of the respondent police or the police officer" and to extend the time for a further period of two weeks to comply with the conditions.

2. The learned counsel for the petitioners submitted that the matter is arising out of matrimonial dispute and hence, the petitioners may by permitted to furnish common sureties who are related to them. He would further submit that the offence under Section 294(b) IPC has been inadvertently mentioned as Section 295(b) IPC in the petition and the same is reflected in the 1st paragraph of the order dated 17.05.2023. Hence, he prays that the Section 295(b) IPC shall be replaced with Section 294(b) IPC.

3. In view of the above submissions, the Criminal Miscellaneous Petitions are ordered. The condition in respect of sureties, is modified to the effect that "the petitioners shall execute a bond for a sum of Rs.10,000/- with two common sureties each for a like sum to the satisfaction of the respondent police or the police officer who intends to arrest or to the satisfaction of the learned Magistrate concerned. https://www.mhc.tn.gov.in/judis

4. A further period of two weeks time is granted to the petitioners, from the date on which the order copy is made ready, to surrender and execute the sureties.

5. In view of the submission made by the learned counsel for the petitioners, Section 295(b) IPC mentioned in the 1st paragraph of the order dated 17.05.2023 in Crl.O.P.No.6628 of 2023 , shall be read as "Section 294(b) IPC".
