(Order of the Court was made by S.S. SUNDAR, J.) This Civil Miscellaneous Petition is filed to condone the delay of 282 days in filing the above Writ Appeal.
2.Though this Court is convinced with the reasons stated in the affidavit filed in support of this petition, the learned counsel appearing for the respondents pointed out that the learned Additional Government Pleader has already produced before this Court the order passed by the Director of Agriculture, dated 11.09.2024, wherein, a sum of Rs.46,29,276/- had been arrived at to be paid to the respondents in compliance of the directions in the writ petition. Referring to the order of the learned Single Judge in contempt proceedings dated 20.09.2024 recording the said fact, the learned counsel for the respondents suggested that the above Appeal has been filed without bona fides, since the appellants have earlier agreed to abide by the directions of the learned Single Judge. The learned Additional Advocate General
submitted that since Contempt Petition has been filed by the respondents and in view of the order of the learned Single Judge, the appellants have decided to comply with the directions without prejudice to their rights to file an Appeal.
3.In such circumstances, this Court is inclined to condone the delay. Accordingly, the delay is condoned and this petition is ordered. 4.Registry is directed to number the above Writ Appeal, if the papers are otherwise in order, and list the same for admission on 21.11.2024.
