ORDER
Petition seeking bail in respect of Crime No.15 of 2026 registered for the alleged offences punishable under Sections 126(2), 296(b), 309(6) and 351(2)of BNS, is on board for consideration.
2. The case of the prosecution is that the petitioner/A2 had waylaid the de facto complainant and snatched 60 grams of silver chain from him and cash of Rs.1500/-. Hence the case.
3. Learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. He also submitted that the petitioner is in no way connected with the alleged offence, however, he is suffering incarceration from 27.03.2026. He further submitted that the petitioner is ready to abide by any stringent condition that may be imposed by this Court. Hence, he prayed for grant of bail to the petitioner.
4. Learned Government Advocate (Criminal Side) appearing for the respondent police, while opposing for grant of bail to the petitioner, reiterated the prosecution case and submitted that the property was not yet recovered and that A1 is still absconding.
5. Heard both sides and perused the materials available on record. 6.Taking note of the facts and circumstances of the case, the gravity of the offence and the submissions made by the learned counsel on either side, this Court is not inclined to grant bail to the petitioner.
