Prayer : Writ Petition filed under Article 226 of the Constitution of India praying to issue Writ of Mandamus directing the Respondents herein to forthwith consider the representation of the Petitioner dated 10.03.2015 by accommodating Master S.Sezhiyan in 1st standard under free fee category.

Heard the learned counsel for the petitioner and the learned counsel for the respondents 1 and 2.

2. The petitioner's husband is working as a driver in a contract firm on daily wage basis. The petitioner's first son is studying in the payment category in the second respondentschool. Therefore, the petitioner made a representation dated

10.03.2015 to the second respondent, stating that the petitioner's first son is already a student in the payment category and therefore the second child viz., S.Sezhiyan will have to be considered under the free fee seat category. 3.The learned counsel for the petitioner submitted that her husband is working as a contract labourer on daily wages basis. Thus, she is unable to pay the fees for both the terms. Therefore, in so far as the admission for her second son viz., S.Sezhiyan is concerned, the same will have to be considered favourably by the respondents by accommodating her in the free seat category.

4. In view of the limited scope of prayer sought for by the petitioner, the representation of the petitioner dated 10.03.2015, for considering the petitioner's second son under the free category is directed to be considered by the respondents favourably. If the vacancies under the said category are filled up, as and when vacancy arises, the petitioner's second child Master S.Sezhiyan will have to be considered favourably, by taking into account the financial condition expressed by the petitioner.
