ORDER
This writ petition has been filed seeking for the issuance of a writ of Mandamus directing the respondents 2 and 3 to deal with the representation made by the petitioner on 14.03.2025, wherein the petitioner has sought for deletion of the name of the 4th respondent and to grant service connection in the name of Arulmighu Sri Karupusamy Ayyanarappan Temple.
2. Heard Mr.K.Prabakaran, learned counsel for the petitioner and Mr.I.Syed Sibghatulla, learned Standing Counsel for respondents 1 to 3.
3. Learned counsel for the petitioner submitted that the property belongs to the Temple and to substantiate the same, the petitioner relied upon the sale deed dated 29.05.2015 and also the Patta that was issued in the year 2023. Learned counsel therefore submitted that instead of granting the service connection in the name of the Temple, it has been granted in the name of a private person viz., the 4th respondent.
2/5
4. Per contra, learned Standing Counsel appearing on behalf of the TANGEDCO submitted that the said status is continuing from the year 2019 onwards and now a representation has been given by the petitioner.
5. In the considered view of this Court, the representation given by the petitioner is pending before the respondents. The respondents 1 to 3 can ascertain as to whether the property stands in the name of the Temple. If that is so, the service connection has to necessarily stand only in the name of the Temple and not in the name of a private individual. However, the fourth respondent shall be put on notice and after conducting an enquiry, the third respondent shall take a decision within a period of six weeks from the date of receipt of a copy of this order. This writ petition is disposed of in the above terms. No costs.
