ORDER
By consent of learned counsel on both sides, this writ petition is taken up for final disposal at the admission stage itself. In view of the order that this Court proposes to pass and also limited relief that is sought to be granted, notice to 4th respondent is dispensed with. 2.The present writ petition is filed praying for a writ of mandamus to direct the respondents 1 to 3 to cancel, remove or delete the wrong entry made in Town Survey Register whereby the 4th respondent herein is shown as the owner of the land in respect of land comprised in Town S.No.270 or 271 situated at Thalakkanancheri Village, Alandur Taluk, Chennai District by passing appropriate order on petitioner's representation dated 20.11.2024.
3.It is submitted by the learned counsel for the petitioner that 2/6
petitioner's father purchased a land bearing Plot No.4/1, comprised in S.No.129 Part, measuring an extent of 2449 sq.ft. under a registered Sale Deed dated 18.06.1997. It is further submitted that petitioner's father purchased another piece of land bearing Plot No.4/1A comprised in S.No.129 Part under Sale Deed dated 09.03.1998. Petitioner submitted a representation dated 20.11.2024 before the Revenue authorities to cancel/ remove/delete the wrong entry made in the town survey register. However, the said representation has not been considered so far by respondents 1 to 3 till date. Aggrieved by the same, the petitioner has come before this Court.
4.At the outset, it is submitted by the learned Special Government Pleader for respondents pursuant to the above representation, the Revenue Divisional Officer had directed the Tahsildar to conduct an enquiry and submit a report and on receipt of such report, the Revenue Divisional Officer would pass appropriate orders within a time frame to be fixed by this Court, which was agreed to by the learned counsel for petitioner.
5.In view of the same, considering the facts and circumstances of 3/6
the case and the limited relief sought for in this Writ Petition, there shall be a direction to 2nd respondent, to consider the case on its own merits and pass appropriate orders in accordance with law, after affording reasonable opportunity of hearing to the petitioner, 4th respondent and any other interested persons/rival claimants, within a period of twelve weeks from the date of receipt of a copy of this order. It is made clear that this Court has not expressed any views with regard to the merits of the petition and it is open to the concerned respondent to consider the petition on its own merits and in accordance with law. 6.Accordingly, the Writ Petition stands disposed of.
