Criminal Revision filed under section 397 r/w 401 of the Code of Criminal Procedure, 1973, to set aside the order in Crl.M.P.No.1456 of 2021 dated 07.06.2022, on the file of Judicial Magistrate Court at Thiruvarur and consequently modify the condition that (i) the petitioner shall execute bond sum of Rs.8,00,000/- and one surety person also execute bond sum of Rs.8,00,000/- (ii) the petitioner shall handover the vehicle original RC Book to the Court.

O R D E R

This revision is filed aggrieved by the order in Crl.M.P.No.1456 of 2021, dated 07.06.2022, passed by the Judicial Magistrate, Thiruvarur, whereby, while ordering the interim custody of the Vehicle Hyundai Verna to the petitioner, a condition was imposed that the petitioner shall execute a bond for a sum of Rs.8,00,000/- and also one more surety for the said sum of Rs.8,00,000/-.

2.The learned counsel for the petitioner would submit that the value of the vehicle itself is about Rs.8,00,000/- and the condition imposed by the trial Court is onerous. 3.Considering the submissions made on behalf of the petitioner and considering the value of the vehicle, the condition imposed by the trial Court is modified as below: The petitioner shall submit the bond for a sum of Rs.4,00,000/- and also produce one surety for the same value i.e., Rs.4,00,000/-. In other respects, the order of the Judicial Magistrate, Thiruvarur is confirmed. 4.Accordingly, the criminal revision is allowed to the extent indicated above.
