When the matter is taken up today, the learned counsel for the appellant submitted that this appeal has been filed for enhancement of 1/3

compensation. During the pendency of this appeal, the Insurance K.RAJASEKAR,J., ssi Company has filed a petition to set aside the ex-parte Award and the same was also allowed. Since, this Appeal filed based on the ex-parte Award passed by the Joint Commissioner of Labour-I, Chennai, which is already aside, nothing further survives in this present Appeal.

2. Accordingly, this Civil Miscellaneous Appeal is dismissed as become infructuous. No costs.
