J] Captioned 'Criminal Miscellaneous Petition' [hereinafter 'Crl MP' for the sake of convenience and clarity] has been filed with 'condonation of delay' ['COD'] prayer. COD is qua 1122 days delay in filing Criminal Appeal being Crl.A.SR.No.25956 of 2023 against judgment dated 11.04.2018 in S.C.No.61 of 2017 on the file of Principal Sessions Court, Namakkal.

2. Mr.E.Raj Thilak, learned Additional Public Prosecutor accepts notice for the respondent and submits that no other appeal has been preferred by the petitioner.

3. Mr.K.V.Muthu Visakan, learned counsel on record for petitioner is before us.

4. Learned counsel, adverting to paragraph No.6 of the support affidavit submits that certified copy of judgment was received only on 22.06.2022.

5. Considering the facts and circumstances of the case and nature of the matter, we accept the reason qua COD prayer. Delay condoned.

6. Sequitur is, captioned Crl MP ordered as prayed for. There shall be no order as to costs.
