CMP No.15893/2023 in CMA SR No.68511/2023 N.ANAND VENKATESH,J., Notice to the 4th respondent is dispensed with since the 4th respondent remained ex parte before the Tribunal. Notice has been served on R1 and R3 and their names have also printed in the cause list. The 2nd respondent is none other than the sister of R1 and R3. However, notice sent to the 2nd respondent has been returned. The claim petition was jointly filed by R1 to R3 and the interest of R2 will be taken case by R1 and R3. Hence, notice is dispensed with in this petition for R2.

This Civil Miscellaneous petition has been filed seeking to condone the delay of 199 days in filing the Civil Miscellaneous Appeal. 3.

Heard the learned counsel for the Appellant and perused the records.

Having satisfied with the reasons assigned in the affidavit filed in support of this petition, the miscellaneous petition is allowed and the delay of 199 days is condoned.

Registry is directed to number the main Civil miscellaneous appeal and list the same for admission. When the matter is posted for admission, the name of learned counsel for R1 and R3 shall be printed in the cause-list.
