This Petition has been filed to condone the delay of 235 days in filing the above Appeal.

2.Claim Petitioners viz., Respondents 1 to 4 were served, paper publication was effected on them and proof for the same also filed. Even though their names printed in the cause list, no one represented on behalf of them.

Mr.B.Sivakollappan, learned counsel appeared for R5.

3.Heard the learned counsel for the Petitioner and R5. Having satisfied with the reasons stated in the affidavit filed in support of this Petition, the delay of 235 days in filing the above Appeal is condoned.

4.The Civil Miscellaneous Petition is ordered, accordingly.

5.Registry is directed to number the Civil Miscellaneous Appeal, if it is otherwise in order and post the same for admission on 04.01.2023.

6.Registry is further directed to print the name of the respondents counsel in the cause list, at the time of admission.
