CMP No.14227 of 2021 in CMA SR No.68529 of 2021 ABDUL QUDDHOSE, J.

Heard the learned counsel for the petitioner.

2. The petitioner/claimant seeks exemption from payment of court fees for filing the subject appeal on the ground that he does not have sufficient means to pay the court fee, as he is only driver.

3. He has also stated in the affidavit, filed in support of the petition, that even though, a claim was made for Rs.20,00,000/-. the Tribunal has awarded only a sum of Rs.1,78,750/- which has also not been paid till date.

4. Having satisfied with the reasons stated in the affidavit filed in support of the petition, the petition is allowed as prayed for.

5. Registry is directed to number the appeal, if it is otherwise in order and list the same for admission on 15.09.2021.

6. It is made clear that if enhancement is granted in the appeal, the appellant shall pay the deficit court fee at the time of applying for the certified copy of the order.
