ORDER : The Court Made the following order :- The petitioner, who apprehend arrest at the hands of the respondent police for the alleged offences punishable under Sections 8(c), 20(b)(ii)(B), 25, 29(1) of NDPS Act 1985 in Crime No.158 of 2021, on the file of the respondent police, seeks anticipatory bail.
2. The case of the prosecution is that on 25.04.2021, the petitioner along with other accused were illegally found in possession of 2 kgs. of Ganja, thereby, the respondent police registered a case against the petitioner and other accused persons.
3. The learned counsel for the petitioner submitted that the petitioner is an innocent person and no way connected with the alleged offence and the petitioner has been falsely implicated in this case. Hence he prays to grant anticipatory bail to the petitioner.
4. The learned Government Advocate submitted that this is the second bail application filed by the petitioner. The petitioner was found in possession of 2 kgs. of Ganja and there are five previous cases pending against him and further the petitioner is a history sheeter in HS.No.54 of 2020. Hence he vehemently opposed to grant anticipatory bail to the petitioner.

5. Taking into consideration of the facts and circumstance of this case and the fact that the petitioner is a history sheeter and there are five previous cases pending against him, Hence, this Court is not inclined to grant bail to the petitioner.
