Writ Petition filed under Article 226 of the Constitution of India praying for the issuance of a writ of Mandamus to direct the 1st respondent to consider and pass orders based on the representation given by the petitioner's sabha dated 19.06.2017 and consequently direct the respondents to grant permission to conduct 18th year Aadi festival for the temple to be held from 11.08.2017 in accordance with law. Mr.M.Maharaja, learned Special Government Pleader, takes notice for the respondents. By consent, the main writ petition itself is taken up for disposal at the admission stage itself.
2. The petitioner has filed the above writ petition to issue a Writ of Mandamus to direct the 1st respondent to consider and pass orders on the representation dated 19.06.2017 and consequently direct the respondents to grant permission to conduct 18th year Aadi festival for the temple to be held from 11.08.2017, in accordance with law.
3. The learned counsel appearing for the petitioner submitted that the petitioner saba has been conducting the Aadi festival for the past 17 years and therefore, they have given a representation dated 19.06.2017 seeking a direction to conduct the Aadi festival for the temple on 11.08.2017, however, the Joint Commissioner has not considered the same yet. 4.Mr.M.Maharaja learned Special Government Pleader, appearing for the respondents submitted that the Joint Commissioner, Chennai, may be directed to consider the petitioner's representation and pass orders, in accordance with law, within a time frame.
5. Having regard to the submissions made by the learned counsel on either side, without expressing any opinion with regard to the merits of the case, I direct the Joint Commissioner, Chennai, to consider the petitioner's representation dated 19.06.2017, which was given by the petitioner in person to the Joint Commissioner, Chennai, and pass orders, in accordance with law, within a period of one week from the date of receipt of a copy of this order. With this observation, the writ petition is disposed of. No costs.
