This writ petition is filed under Article 226 of the Constitution of India seeking writ of mandamus, directing the respondents to pay interest @ 10 percent for the belated payment of terminal benefits such as Gratuity, Provident Fund, Leave Salary and commutation amount and difference in leave salary and difference in gratuity with 10 percent interest as per 15th wage

settlement dated 29.05.2025 to the petitioners. For Petitioner(s):

ORDER

This writ petition is filed for the following relief: "To direct the respondents to pay interest @ 10 percent for the belated payment of terminal benefits such as Gratuity, Provident Fund, Leave Salary and commutation amount and difference in leave salary and difference in gratuity with 10 percent interest as per 15th wage settlement dated 29.05.2025 to the petitioners.

2. Heard the learned counsel appearing on either side and perused the materials available on record.

3. The petitioners joined the service of the respondent corporation as Conductor, Driver and Technical Staff and retired from service on 30.06.2023, 31.05.2024 and 30.04.2025, respectively. Subsequently, the 15th Wage Settlement was entered into between the Management and the

Trade Unions on 29.05.2025, pursuant to which the wages and pension were also revised with effect from 01.09.2023. Since the petitioners had retired on 30.06.2023, 31.05.2024 and 30.04.2025, respectively they are entitled to the difference in leave salary and gratuity as per the 15th Wage Settlement. Accordingly, the petitioners submitted a representation seeking interest for the belated payment and difference in gratuity as well as revised pension as per the 15th wage settlement dated 29.05.2025. However, the said representation has not been considered so far.

In view of the above, the respondents are directed to pay interest at 6 percent for the belated payment of terminal benefits such as Gratuity, Provident Fund, Leave Salary and commutation amount and difference in leave salary and difference in gratuity with 6 percent interest as per 15th wage settlement dated 29.05.2025 to the petitioners, within a period of twelve weeks from the date of receipt of a copy of this order. 5.With the above direction, this Writ Petition stands disposed of. No costs.
