ORDER

This Criminal Original Petition has been filed to direct the 2nd respondent to not to harass the petitioner by appreciating the facts and

circumstances of the case.

2.The learned counsel for the petitioner submitted that third respondent is a tenant under the petitioner. The eviction proceedings against the third respondent filed by the petitioner went up to Hon'ble Supreme Court and Hon'ble Supreme Court confirmed the order of eviction. Subsequently, as per the order passed in Execution Petition in E.P.No.20 of 2016 on the file of the learned Additional District Munsif, Vellore, possession of the property was taken. Thereafter, the third respondent gave a false complaint against the petitioner on 03.12.2021 and that was enquired and closed. After change of officer in Vellore Police Station, the third respondent again gave a false complaint. On the basis of the complaint, petitioner is unnecessarily harassed by the respondents. Therefore, this petition is filed.

3.In response, the learned Government Advocate (Criminal side) submitted that, on the basis of the complaint given by the third respondent, enquiry was conducted and closed. Petitioner is not required for any

enquiry anymore.

4. Recording the submission of the learned counsel appearing for parties, especially the submission of the learned Government Advocate (Criminal side), that petitioner is not required for any further enquiry, this Court is of the view that no order need be passed in this petition. 5.Accordingly, this Criminal Original Petition is disposed of. 09.06.2023 Index: Yes/No Speaking/Non speaking order ep
