The petitioner, who was arrested and remanded to judicial custody on 11.05.2024 for the offences under Sections 366 of IPC and Section 7 & 8 of POCSO Act, 2012 in Crime No.7 of 2024 on the file of the respondent police, seeks bail.
2.The case of the prosecution is that the accused aged about 53 years old, kidnapped the victim who is 10 years old, to a lonely place and committed the offence of sexual assault. Hence the complaint. 3.The learned counsel for the petitioner submitted that he is an innocent and he is no way connected with the said alleged offences and he has not committed any offence as alleged by the prosecution and he has falsely implicated in the above said criminal case. He is a law abiding citizen and he will not abscond and ready to cooperate with the investigation and he is ready to furnish substantial sureties for his due appearance. Hence, he prays to grant anticipatory bail to the petitioner.

ah 4.The learned Government Advocate (Crl.Side) appearing for the respondent submitted that in this case investigation has not been completed. The petitioner herein compelled the victim girl and sexually assaulted her. If he is enlarged on bail, he may tamper the evidence. Hence he vehemently opposed to grant anticipatory bail to the petitioner. 5.Heard the learned counsel for the petitioner and the learned Government Advocate (Crl.side) for the respondent and perused the entire materials available on record.
6.Taking into consideration of the facts and circumstances of the case and the submissions made by the learned Government Advocate (Crl.Side) and considering the gravity of the offence and also taking note of the fact that the case is at initial stage and it needs detailed investigation. Hence, this Court is not inclined to grant bail to the petitioner. 7.Accordingly, this Criminal Original Petition stands dismissed. 10.06.2024 ah 2/3
