Petition under Article 226 of the Constitution of India, praying for the issue of a Writ of Mandamus, directing the respondents to fix salary of the Probation Officers commensurate with that of the Observation Home Superintendent in the scale of pay 9300-34800/- with grade pay of Rs.5100/-. ORDER

It is pleaded that all the petitioners are working as Probation Officers in the scale of pay of Rs.9300-34800 with Grade Pay of Rs.4900/-, which is the scale of pay for the post of Office Manager/Office Superintendent being the feeder category in promotion for the post of Probation Officer.

2. Learned counsel for the petitioners submitted that the Government of Tamil Nadu framed adhoc rules for appointment of Probation Officers in the ratio of 1:1:1. It is the further claim of the petitioners that after they were appointed as Probation Officers, they should be given the scale of pay of Rs.9300-34800 with Grade Pay of Rs.5100/-. When the petitioners have sent a representation in this regard, till date, the Department has not considered the same. Therefore, they have come to this Court seeking a direction to consider the pending representation.

3. The learned Additional Government Pleader, taking notice on behalf of the respondents, sought eight weeks time to consider the pending representation.

4. This Court hereby directs the respondents to consider and dispose of the pending representation of the petitioners on merits and in accordance with law within a period of six weeks from the date of receipt of a copy of this order.
