PRAYER: Criminal Original Petition filed under Section 482 of Criminal Procedure Code, to direct the first and second respondent police officials not to grant any permission for conducting cultural dance programme at Sri Draupadi Amman Temple, Madarkalir Manickam Village, Srimushnam Taluk, Cuddlore District on 01.07.2022 or any other subsequent dates. O R D E R

This Criminal Original Petition has been filed to direct the first and second respondents police officials not to grant any permission for conducting cultural dance programme at Sri Draupadi Amman Temple, Madarkalir Manickam Village, Srimushnam Taluk, Cuddlore District on 01.07.2022 or any other subsequent dates.

2. It is brought to the notice of the petitioner that the other side had moved the Petition in W.P.No. 16300 of 2022 before this Court and obtained order on 28.06.2022. This Court while passing an order in fact directed the Police to hear the other side in the event of any rival claim arises in respect of conducting the Cultural programme.

3. In such view of the matter, it is for the Police to take a call whether to give permission or not based on the ground reality that whether such permission led to law and order problem. In the event of granting permission to one side resulting in law and order problem, it is well open to the respondent Police not to grant any permission till the peace committee is conducted and matter settled between the parties.

4. With the above direction, this Criminal Original Petition is allowed.
