ORDER

(Order of the Court was made by J.NISHA BANU J.) The present Writ Petition is filed for the issuance of a Writ of Mandamus to direct the first respondent to consider the petitioner's representation dated 03.04.2025.

2. The learned counsel for the petitioner submits that the petitioner and the third respondent are neighbours. The petitioner purchased a house at No.182, Masthan Gori Street, Adambakkam, Chennai, in S.No.187/18 to an extent of 1499 sq.t. vide Document No.4073 of 2017 registered on the file of the Sub Registrar, Alandur, Chennai. One Srinvasan/ the third respondent herein purchased a house site at door No.181, Masthan Gori Street, Adambakkam, Chennai, in S.No.187. Now, the third respondent is constructing a house without getting approval from the Corporation, which is in violation of the Building and

Planning Rules. Hence, the petitioner made a representation dated 03.04.2025 before respondent Nos.1 and 2 to take suitable action against the unauthorised construction made by the third respondent. but, till date, the official respondents did not take any action in this regard. Hence, the present Writ Petition is filed.

3. Heard the learned counsel appearing for the petitioner and Mr.E.C.Ramesh, learned Standing Counsel appearing for respondent Nos.1 and 2 and perused the materials placed before this Court.

4. Considering the facts and circumstances of the case, this Court directs respondent Nos.1 and 2 to consider the petitioner' representation dated 03.04.2025 and pass appropriate orders, on merits and in accordance with law, after issuing notice to the petitioner and the third respondent and also affording them an opportunity of personal hearing, within a period of eight (8) weeks from the date of receipt of a copy of this order.

5. With the above directions, this Writ Petition is disposed of. There shall be no order as to costs. Consequently, connected Miscellaneous Petition is closed.
