COMMON ORDER On receipt of the summon, the petitioners had sent a mail to the respondent police giving an undertaking that they will appear for enquiry on 14.06.2024. Apprehending harassment by the police, the present Criminal Original Petition is filed.

The learned Government Advocate (Crl.Side) appearing for the respondent police states that based on the complaint, the petitioners sought to be enquired and there is no intention of harassment. 3.

The learned counsel appearing for the petitioner states that an arbitration proceedings is pending between the parties and therefore, there is no material for investigation.

Be that as it may, it is the duty of the petitioners herein to participate in the enquiry and place the material before the Investigating Officer for his satisfaction whereas the case fit for investigating or not. Since summons already issued to the petitioners, it is suffice to direct the petitioners to appear before the respondent police for enquiry and on such appearance, the enquiry will be conducted in accordance with law. 2/4

With the above direction, this Criminal Original Petitions are disposed of.
