ORDER : The Court Made the following order :- The petitioner who was arrested on 01.02.2020 and remanded to judicial custody for the offences punishable under Sections 8(c), r/w 20(b)(ii)(C), 27A and 29 of the NDPS Act, in C.C.No.83 of 2020 pending trial before the Principal Sessions Judge for NDPS Act, Cases, Chennai, seeks bail.

2. The case of the prosecution is that the petitioner along with other accused persons were unlawfully found to be in possession of 26 kgs of Ganja. Hence, the complaint, 3.The learned counsel appearing for the petitioner submitted that the petitioner has not committed any offence as alleged by the prosecution and he has been falsely implicated in this case and prays for grant of bail to the petitioner.

4. The learned Government Advocate (Crl.Side) submitted that the petitioner along with other accused persons were unlawfully found to be in possession of 26 kgs of Ganja. He further submits that there is a commercial quantity. Hence, he vehemently opposed for grant of bail to the petitioner.

5.Considering the facts and circumstances of the case and also the fact that there is a commercial quantity, this Court is not inclined to grant bail to the petitioner.

6.Accordingly, this Criminal Original Petition is dismissed. -sd/- 18/08/2021 This order, on being produced, be punctually observed and carried into execution by all concerned TRUE COPY Sub-Assistant Registrar (Statistics/C.S.) High Court, Madras - 600 104.
