This Civil Revision Petition has been filed as against the impugned Order of the learned Judicial Magistrate No.III, Coimbatore, refusing to review the Order passed in CMP.No.3005 of 2024 in DVA.No.421 of 2019.

2. The petitioner has filed an application under Section 12 of the Domestic Violence Act. The learned Judicial Magistrate has restrained the respondents from committing any further domestic violence on the revision petitioner. That apart, the learned Magistrate has directed the respondents to pay a sum of Rs.5 lakhs to the revision petitioner. However, the prayer with regard to return of articles said to be belonged to the revision petitioner has been negatived by the learned Judicial Magistrate, by an order dated 26.12.2023. The revision petitioner has filed a petition to review of the Order of the learned Magistrate, which has been dismissed by an Order dated 27.11.2024. Challenging the said Order, the present revision has been filed. Page 2 / 5

3. I have perused entire materials. The very review sought itself is without any basis, as there is no error apparent on the face of the records. Instead of filing an appeal in respect of one of the relief sought which has been negatived, the review petition has been filed. The learned Magistrate has rightly dismissed the said application as there is no error apparent on the face of the record. While dismissing the application, the learned Magistrate has pointed out that even in the main application there were no particulars mentioned as to the nature of the articles and such a plea has been introduced only in the review petition. Considering the above facts, this Court is of the view that the Order of the learned Judicial Magistrate does not require any interference.
