13881 of 2018)pending disposal of the above writ petition WP.11888/2018. Order : This petition coming on for orders upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of M/S.T.SATHIYAMOORTHY, Advocate for the petitioner and of Mr.V.KADHIRVELU, Special Government Pleader on behalf of the Respondents the court made the following order:- Heard the learned counsel for the petitioner in Writ miscellaneous petition, so also learned counsel for the respondents.
2. It appears that this writ miscellaneous petition has been filed by the petitioner seeking for grant of subsistence allowance due to the petitioner as per Rule 17(4) of the Tamil Nadu Village Panchayat Secretaries (conditions of Service) Rules 2013, pending disposal of the writ petition.
3. Needless to say that the petitioner is entitled to subsistence allowance if it not paid during the period of his suspension, which is not in dispute. The prayer made by the petitioner in this writ miscellaneous petition appears to have merit and accordingly, this Court dispose of this writ miscellaneous petition with a direction to the respondents to release the subsistence allowance to which the petitioner is entitled to, in accordance with law, if not already paid, within a period of two weeks from the date of production of a copy of this order.
4. With the aforesaid direction, the writ miscellaneous petition stands disposed of.
