These Civil Miscellaneous Petitions have been filed seeking to set aside the abatement causes due to the death of 1st respondent and to bring on record the proposed 4th respondent as legal representatives of deceased 1st respondent.

2. Today, when the matter taken up for hearing, the learned counsel for petitioner/proposed 4th respondent appeared and submitted that pending appeal, the 1st respondent died on 15.06.2020. Hence, he has filed the above petitions.

3. Dr.S.Suriya, learned Addl. Govt. Pleader appearing for 3rd respondent appeared and raised formal objections.

4. Considering the facts and circumstances, and being satisfied with the reasons assigned in the affidavit, both the petitions are allowed. The proposed legal representative of the 1st respondent is impleaded as 4th respondent in the above Second Appeal.

5. Issue notice to the proposed 4th respondent through court and post returnable by 04.08.2022. Private notice is also permitted.

6. Registry is directed to carry out necessary amendment in the cause title and post the matter on 04.08.2022 for arguments. 19.07.2022 rpp
