ORDER

The writ petition is filed for the below relief: "directing the respondent to pay the surrender leave salary for 45 days with interest @ 9 percent p.a. for the earned leave surrendered encashment during

2017, 2018, 2019 at 15 days for each year within the time limit that may be fixed by this Court ".

2. The brief facts which has culminated in the filing of this writ petition are set out below:

2.1. It is the case of the petitioner that the petitioner was working as Selection Grade Conductor and retired from service. The respondents had not settled the surrender leave salary for 45 days. Therefore, the respondents are legally bound to pay the same along with the interest to the petitioner. Therefore, the petitioner made a representation to the respondent to pay the aforesaid sum along with interest at the rate of 9% per annum. Since there is no response, the petitioner is before this Court.

3. Heard the learned Counsel on either side and perused the materials available on records.

4. Admittedly, the surrender leave salary for 45 days has been paid belatedly for no fault of the petitioner. Therefore, the petitioner is entitled to the aforesaid sum along with the interest on the same. Therefore, the Writ petition is allowed as prayed for and a mandamus is issued directing the respondents to disburse surrender leave salary for 45 days with interest @ 6 percent p.a. for the

earned leave surrendered encashment during 2017, 2018, 2019 at 15 days for each year within a period of one (1) month from the date of receipt of a copy of this order. No costs.
