Writ petition filed under Article 226 of the Constitution of India praying for issuance of Writ of Mandamus directing the respondent herein to register the petitioner's Release Deed dated 28.04.2017 kept pending registration in P201700093 on the file of respondent and release the same to the petitioner forthwith.

ORDER

The petitioner seeks for a mandamus directing the respondent to register the petitioner's Release Deed dated 28.04.2017 kept as pending in Document No. P201700093.

Heard both sides.

It is stated that the subject matter of the property was belonging to his father absolutely. It is further stated that the petitioner's father died on 22.08.2005 leaving behind the petitioner and other legal heirs. It is stated that the other legal heirs, out of love and affection, have released their respective share in the subject matter property, in favour of the petitioner by way of Release Deed dated 28.04.2017 which was presented for registration before the respondent.

4. The grievance expressed by the petitioner is that the respondent has not registered the document so far, even though, he has received the same and given a pending registration No.P201700093. Needless to say that the respondent, having received the document, should either register the same or return to the petitioner, if there is any illlegal impediment for registering the same. Without doing either of these things, the respondent cannot keep the matter pending for a long time. Therefore, the writ petition is disposed of, by directing the respondent to take appropriate action on the document viz., the Release Deed dated 28.04.2017, presented by the petitioner for registration

within a period of three weeks from the date of receipt of copy of this order. No costs.
