This writ petition has been filed for the issue of a writ of mandamus directing the respondents 1 to 3 to act upon the representation made by the petitioner on 10.02.2025 and take action against the 4 th respondent who is illegally running a ladies hostel.
2. Heard both sides and perused the materials placed on record.
3. It is seen from records that the petitioner's wife went missing on 03.05.2024 and thereafter, she never returned to the matrimonial home. A complaint was given to the jurisdictional police at Thoothukudi District and an FIR came to be registered in crime No.74/2024. Thereafter, H.C.P.(MD) Nos.664/2024 and 1357/2024 were filed by the petitioner before the Madurai Bench of Madras High Court. After notice, the petitioner's wife was produced before the Court. It is alleged that she informed the Court that she was confined in the hostel run by the th respondent by her family members. She also expressed her willingness to join 2/4
with the petitioner. When the said H.C.P. came up for hearing on 12.11.2024, the statement of the detenue was recorded and the H.C.P. was disposed of.
4. The grievance of the petitioner is that the 4 th respondent hostel is being run without proper license. On carefully reading the order passed by the Division Bench, there is nothing to show that the detenue made a statement to the effect that she was illegally detained in the 4 th respondent hostel by her family members. In any case, the wife has now joined the petitioner and no useful purpose will be served in further precipitating the issue based on some representation made by the petitioner, who is residing in Thoothukudi to take action against the hostel which is functioning in Chengalpattu. A pure and simple family dispute is now sought to be enlarged for taking action against a ladies hostel which is allegedly being run without proper license. Such collateral actions will eat away the precious time of this Court while dealing with genuine cases. Hence, this Court is not inclined to exercise its discretion under Article 226 of the Constitution of India. In the light of the above discussion, this writ petition is dismissed.
