The petitioner, who was arrested and remanded to judicial custody on 08.02.2024 for the offences punishable under Sections 5(l), 5(n), 5(j)(ii), 6 of Protection of Child from Sexual Offences Act, 2012 in Crime No.6 of 2024 on the file of the respondent police seeks bail. 2.The case of the prosecution is that the defacto complainant has a habit of going to his paternal uncle's house regularly in weekly basis where she was sexually harassed by his paternal uncle and made intercourse with him and now, she is six months pregnant. Hence the complaint. 3.The learned counsel for the petitioner submitted that he is a sole bread winner of the family and he is responsible for his family's growth and his child education. He is a law abiding citizen and no crime case is pending against him. Hence, he seeks for grant of bail to the petitioner. 4.The learned Government Advocate (Crl.Side) appearing for the respondent opposed for granting bail to the petitioner stating that the petitioner 1/3

is the paternal uncle of the victim girl. He abused her and made a intercourse with T.V.THAMILSELVI, J.

ah the victim girl and she became pregnant. Investigation is still pending. If the petitioner is enlarged on bail he will tamper the evidence and hamper the witnesses.

5.Considering the facts and circumstances, and also considering the submissions made by the learned Government Advocate (Crl.Side), and considering the gravity of the offence committed by the petitioner, this Court is not inclined to grant anticipatory to the petitioner.
