ORDER

The petitioner, who was arrested and remanded to judicial custody on 29.07.2025 for the alleged offences under Sections 8(c) r/w 20(b)(ii)(c) of Narcotic Drugs and Psychotropic Substance Act, 1985, in Crime No.31 of 2025 on the file of the respondent police, seeks bail.

2. The case of the prosecution is that on 28.07.2025, the respondent police recovered 21.500 kilograms of ganja from the possession of the petitioner. Hence the case.

3. The learned counsel appearing for the petitioner would submit that there are about two accused in this case and another accused namely Vishnu has also been secured and arrayed as an accused. It is further submitted that the petitioner is suffering from mental illness and has been under psychiatric treatment. He further submitted that the petitioner is ready to abide by any stringent conditions that may be imposed by this Court. Hence, he prayed for grant of bail to the petitioner.

4. The learned Government Advocate (Crl. Side) would oppose the application on the ground that the entire recovery of 21.500 kilograms of ganja is from this petitioner. Hence, he opposed to grant bail to the petitioner.

5. I have given anxious consideration to the submissions made by the learned counsel on either side.

6.This Court is of the view that though the learned counsel would contend that there are two accused, the present factual position shows that the entire recovery of 21.500 kilograms of ganja is from this petitioner. Considering the

recovery of commercial quantity from the petitioner and in the absence of any material to overcome the rigour under Section 37 of the NDPS Act, this Court is not inclined to grant bail to the petitioner.
