Respondents Prayer:- Writ petition filed under Article 226 of the Constitution of India praying for a writ of mandamus directing the 1st respondent to select and appoint the petitioner to the post of Assistant Professor [Botany] under reserved category of Scheduled Caste [SCG] based on the merits in the selection in pursuant to the prospectus issued by the 1st respondent dated May 2013 with all consequential and other attendant benefits within a time frame to be fixed by this Court.

ORDER

By consent, the writ petition is taken up for final disposal. The petitioner would state that he is hailing from poor family and belongs to Scheduled Caste community and he is having the qualification of B.Sc. [Botany] well as M.Sc., [Botany], both from Annamalai University and subsequently, qualified with M.Phil as well as Ph.D., from the very same University and is having all necessary and requisite qualification for appointment to the post of Assistant Professor in Tamil Nadu Collegiate Education Service. The petitioner would further state that in response to the Notification in May 2013, issued by the 1st respondent for direct recruitment to the post of Assistant Professor in the above said https://hcservices.ecourts.gov.in/hcservices/

Education Service for Government Arts and Science Colleges-2012, the petitioner has applied for the same and he has attended the Certificate verification and also attended oral interview and was awarded 17 marks in Cv and 7 marks in the interview and thereby securing 24 marks in total. The grievance now expressed by the petitioner is that though based on the merit list, he should have been given appointment as Assistant Professor under the Scheduled Caste category, in the final selection list, as against his name, it has been indicated as "reserved" and hence, he came forward to file this writ petition.

Heard the learned counsel for the petitioner and Mr.V.Subbiah, learned Special Government Pleader, who accepts notice on behalf of the respondents.

Though the petitioner has prayed for a larger relief, this Court, in the light of the above facts and circumstances, permits the petitioner to submit a representation to the 1st respondent within a period of two weeks from the date of receipt of a copy of this order and the 1st respondent, on receipt of such representation, shall consider and dispose of the same on merits and in accordance with law and pass orders within a further period of four weeks thereafter and communicate the decision taken, to the petitioner.
