WMP.No.21339 of 2024 in WP.No.8924 of 2024 D.BHARATHA CHAKRAVARTHY, J., This petition has been filed to recall the order dated 01.04.2024 passed in W.P.No.8924 of 2024 and to permit the petitioner to conduct the case on merits in W.P.No.8924 of 2024 in accordance with law.

2.This petition has been filed on the ground that the petitioner never gave any instructions to the learned Senior Counsel. Since such an allegation is made as against the counsel, this court posted the matter today and directed to service of set of papers to the learned counsel originally appearing. Upon service of papers, M/s.Suneetha, learned counsel originally appearing for the petitioner categorically submitted that when the matter came up for admission, upon querry of this Court, she had asked for passover only after getting instructions from the petitioner, such an undertaking was given before this court.

In fact, this Court also distinctly remembers that the matter was passed over, and only in the afternoon such an undertaking given by the learned counsel.

3.In view thereof, I am unable to accept the reasons mentioned in the affidavit to recall the order and I find that the petitioner after giving such an undertaking through the Counsel, now filed affidavit by stating that she has given such an undertaking. 4.Accordingly, this Writ Miscelleneous Petition is dismissed. 08.08.2024 dss
