This Criminal Original Petition has been filed by the petitioner, who was arrested and remanded to judicial custody on 20.02.2024, seeking bail in Crime No.15 of 2024 for the alleged offences punishable under Sections 341, 323, 302, 506(ii) r/w 34 of IPC.

2. Learned counsel appearing for the petitioner submitted that this is the second application for bail filed by the petitioner before this Court and this Court had dismissed the earlier bail application in Crl.O.P.No.10478 of 2024 vide order dated 29.04.2024. He further submitted that the petitioner is no way connected with the alleged offence and he has been suffering incarceration from 20.02.2024. He also submitted that the petitioner is ready to abide by any stringent conditions that may be imposed by this Court. Hence, he prayed for granting bail to the petitioner.

3. Learned Additional Public Prosecutor (Puducherry) appearing for the respondent police raised objection for granting bail to the petitioner stating that due to the previous enmity, the accused had waylaid the deceased/victim and his friend while they were going in a bike and committed murder of the victim, brother of the de facto complainant, by assaulting them with hands and knife.

4. He further submitted that there are four accused in this case and the investigation in this case is still pending, therefore, if the petitioner is released on bail at this stage, there is a possibility of him absconding and would threaten the witnesses.

5. Heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor (Puducherry) and perused the materials available on record including the counter filed by the respondent.

6. Considering the submissions made by the learned Additional Public Prosecutor (Puducherry) that the investigation is at initial stage and also considering the nature and gravity of the offence committed by the accused, this Court is not inclined to grant bail to the petitioner.
