ORDER

Petition seeking bail in respect of Crime No.112 of 2026 registered for the offences punishable under Sections 75(2) of BNS & 66E IT Act r/w Section 4 of TNPHW Act, is on board for consideration.

2. The learned counsel for the petitioner submitted that the de facto complainant sold her property to the petitioner and the petitioner had settled the

entire amount through RTGS and bank transaction. Later, the de facto complainant demanded higher amount, and when the petitioner refused to pay the amount, she has given a false complaint and attempted to threaten the petitioner by police action. He further submitted that the phone of the petitioner has been recovered and the petitioner has been incarcerated since 17.03.2026 and that the major portion of the investigation has been completed. He further submitted that out of seven cases, all the cases are disposed of and other than the present case, there is no case pending against the petitioner. He further submitted that the co-accused has been enlarged on bail. 3.

The case of the prosecution as put forth by the learned Government Advocate (Criminal Side) appearing for the respondent police, opposing for grant of bail, is that the petitioner/Accused had purchased the property from the de facto complainant and had not returned the balance amount and when the de facto complainant demanded the balance amount, the petitioner threatened to upload her obscene videos. The learned Govt Advocate (Crl.Side) appearing for the respondent police further submitted that the petitioner is an habitual offender.

Having heard the learned counsel for the petitioner, the learned Government Advocate (Criminal Side) for the respondent Police and perused the materials available on record and considering the period of incarceration undergone by the petitioner, this court is inclined to grant bail to the petitioner with certain conditions and accordingly, the petitioner is ordered to be released

on bail on his executing bond for a sum of Rs.15,000/- (Rupees Fifteen Thousand only) with two sureties, each for a like sum to the satisfaction of the learned Judicial Magistrate, Additional Mahila Court, Salem, and on further conditions that:

[a] the sureties shall affix their photographs and Left Thumb Impression in the surety bond and the Magistrate may obtain a copy of their Aadhar card or Bank pass Book to ensure their identity;

[b] the petitioner shall report before the respondent police everyday at 10.30 a.m for a period of 15 days and thereafter as and when required for interrogation;

[c] the petitioner shall not abscond either during investigation or trial;

[d] the petitioner shall not tamper with evidence or witness either during investigation or trial;

[e] On breach of any of the aforesaid conditions, the learned Magistrate/Trial Court is entitled to take appropriate action against the petitioner in accordance with law as if the conditions have been imposed and the petitioner released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)AIR SCW 5560];

[f] If the accused thereafter absconds, a fresh FIR can be registered under Section 269 of B.N.S.
