ORDER
This Crl.O.P., has been filed under Section 407 of the Code of Criminal Procedure, 1973, praying to transfer Special Case No.8 of 2014 from the file of Chief Judicial Magistrate Court, Tiruvallur to some other Court, either to Chief Judicial Magistrate, Tiruvannamalai or Chief Judicial Magistrate Court, Villupuram.
2. It is averred in the petition that the petitioner has been arrayed as sole accused in Special Case No.8 of 2014 on the file of the Chief Judicial Magistrate Court/Special Court, Tiruvallur. Further, it is stated in the petition that the petitioner belongs to Salem District and in the said circumstances, he has to travel a long https://hcservices.ecourts.gov.in/hcservices/
distance from his native place, so as to attend the court proceedings and therefore, the present petition has been filed.
3. The learned counsel appearing for the petitioner has simply reiterated the averments made in the petition.
4. The learned Additional Public Prosecutor has contended that the reason given in the petition is not at all sufficient to grant the relief sought for therein and therefore, the present petition deserves to be dismissed.
5. It is an admitted fact that the petitioner has been arrayed as sole accused in Special Case No.8 of 2014 pending on the file of the Chief Judicial Magistrate/Special Court, Tiruvallur. The only reason given in the petition is that the petitioner belongs to Salem District and he has to face so much troubles and tribulations in attending the court proceedings. The reason given in the petition is not at all sufficient for granting the relief sought for therein. Therefore, the present petition deserves to be dismissed. In fine, this Crl.O.P., is dismissed. Consequently, M.P.No.1 of 2015 is also dismissed.
