ORDER
The case of the petitioner is that his brother Murugesan, originally purchased the property in Survey Nos.474/3, 474/4, 474/5 and 474/10A at Paiyanur Village, Thiruporur Taluk, Chengalpattu District, to an extent of 80 cents from one Elumalai vide doc.No.1657 of 2006. Subsequently, the said
Murugesan executed a settlement deed in favour of the petitioner for the land in S.Nos.474/3B, 474/4B, 474/5B and 474/10A for an extent of 60.5 cents vide Doc.No.5514 of 2022 dated 17.03.2022 on the file of SRO, Tiruporur. The petitioner contends that she is in absolute possession and enjoyment of the property and obtained patta in patta No.3285. As the third respondent is allegedly obstructing the petitioner from fencing the property, a representation was sent seeking Police protection.
2.The learned Additional Public Prosecutor appearing for R1 and R2 submits that upon receipt of petitioner's complaint, C.S.R.No.63 of 2026 was assigned. During the field enquiry, it was observed that the property has not been physically divided by metes and bounds between the petitioner's portion and the remaining portion belonging to his brother. In the absence of clear demarcation of boundaries, the Police are not in a position to grant protection for fencing at this stage. It is submitted that the petitioner must first approach the Revenue Department to have the land surveyed and earmarked. 3.The learned counsel for the petitioner submits that the petitioner will promptly take steps to have the property surveyed and earmarked by the Revenue Authorities and will thereafter approach the respondent police for necessary protection.
4.Recording the submissions made on both sides, this petition is disposed of. The petitioner is at liberty to move the Revenue Department for a survey and, earmark the property with metes and bounds, thereafter renew his request for police protection. No costs.
