O R D E R

This writ petition is filed to call for the records of the 2nd respondent relating to the order in Pro.Na.Ka.No.1925/2003/A8 dated 27.03.2003, to quash the same and to issue consequential directions to the respondents to reinstate the petitioner in service with consequential benefits, disburse arrears of subsistence allowance from February 2008 onwards forthwith with interest.

2. The order of suspension dated 27.03.2003 suspending the petitioner pending enquiry is put under challenge. When the writ petition was filed, the petitioner was 59 years old, apparently, he has reached the age of superannuation and therefore, the question of reinstatement with backwages into service will not arise. If the petitioner is of the view that if any subsistence allowance is due, the petitioner is at liberty to work out his remedy.

3. With the above observations, the Writ Petition stands closed since no effective orders can be passed for reinstatement. No costs. Consequently, connected miscellaneous petitions are closed.
