O R D E R
The instant writ petition has been filed with a prayer for issuing a Mandamus, to direct the respondents to pay interest at 6% p.a., on the belated payment of difference in commutation of pension amount and Contributory Retirement benefits scheme amount from the date of retirement (31.03.2016) to till the date of actual disbursement within a time limit.
2. It is the case of the petitioner is that the petitioner served in the Respondent-Transport Corporation for 32 years of unblemished service and on attaining the age of superannuation, he retired from service as Assistant Manager (Legal) on 31.03.2016. The learned counsel for the petitioner would submit that though he retired from service during 2016, his terminal 2/6
benefits were paid only from the year 2021, after lapse of five years. However, no interest was paid for the above period. In view of the same, the petitioner submitted a representation dated 08.04.2025 to the respondents to pay interest for the delayed period. Since the same was not considered by the respondents, the present Writ Petition has been filed.
3. The learned Standing Counsel for the respondents would fairly admits that in view of the similar orders passed by this Court in W.P.Nos. 40031, 33742 and 35806 of 2024, they are willing to pay the interest at the rate of 6% per annum for the belated payment of the eligible and admissible amount.
4. Heard the learned counsel for both sides and perused the materials available on record.
5. In view of the above submission of the learned Standing Counsel, this Court deems it appropriate to direct the respondents to pay the interest at the rate of 6% per annum, from the date of retirement till the date of actual disbursal of the terminal benefits to the petitioner, within a period of six weeks from the date of receipt of copy of this order.
6. With the above direction, the Writ Petition is disposed of. No costs. 3/6
