O R D E R

This writ petition has been filed seeking issuance of a writ of mandamus directing the first respondent to dispose of the appeal filed by petitioner on 09.02.2024, wherein the petitioner has sought for cancellation of patta.

2. By consent of learned counsel on both sides, this writ petition is taken up for final disposal at the admission stage itself. Since no adverse order is going to be passed, notice to second respondent is dispensed with.

3. Learned Special Government Pleader appearing for first respondent would submit that first respondent would conduct an enquiry after affording reasonable opportunity of hearing to petitioner, second respondent and any other interested parties and the appeal would be disposed of and orders will be passed within the time frame to be fixed by this Court

4. Taking into consideration the facts and circumstances of the

case and the submissions made on either side, there shall be a direction to first respondent to consider the appeal made by petitioner on 09.02.2024 and conduct enquiry by issuing notice to petitioner, second respondent and interested parties, if any and affording an opportunity of hearing to petitioner, second respondent and any other interested parties and the orders shall be passed on its own merits within a period of sixteen weeks from the date of uploading of the web copy without waiting for the receipt of certified copy. It is made clear that this Court has not expressed any view with regard to the merits of the case and it is open to first respondent to consider the case on its own merits and in accordance with law.
