ORDER

This Criminal Original Petition has been filed by the petitioner to quash the FIR in Crime No.125 of 2024 registered for the offence under Sections 409 and 420 IPC and Section 66D of Information Technology (Amendment) Act, 2008, on the file of the first respondent police in so far as the petitioner is concerned.

2. The case of the prosecution is that the petitioner cheated the defacto complainant/second respondent to the tune of Rs.4,40,190/- by way of sharing a link in the telegram group and inducing the defacto complainant to invest money. Hence, the case.

3. The learned counsel for the petitioner submitted that the petitioner is no way connected with the alleged offence and he has not received any amount 2/6

in his bank account. The petitioner is only a travel agent who used to book flight ticket and Visa to the persons who approaches him and apart from that he is nothing to do with the persons to whom he arranges Visa and flight tickets. Without any allegation and averments as against the petitioner in the complaint, the respondent police arrested the petitioner in this case which is in violation of human rights. Hence, the present petition is filed to quash the FIR as against the petitioner.

4. Heard the learned counsel for the petitioner and the learned Government Advocate (Crl. Side) appearing for the first respondent police and also perused the materials available on record.

5. Since no adverse order is being passed against the second respondent, notice to the second respondent is dispensed with.

6. A reading of the contents of the FIR shows prima facie material to proceed with the case. Therefore, this Court is not inclined to quash the FIR. 3/6

7. Since the FIR in Crime No.125 of 2024 has been registered in the year 2024 i.e. on 27.04.2024, the respondent police is directed to complete the investigation and file the charge sheet within a period of three months from the date of receipt of a copy of this order.

8. With the above directions, this Criminal Original Petition is dismissed at the admission stage itself. Consequently, the connected Miscellaneous Petition is closed.
