Crl.M.P.No.8689 of 2024 Crl.M.P.No.8689 of 2024 in Crl.O.P.No.11092 of 2024 T.V.THAMILSELVI, J., This petition has been filed to modify the condition imposed on the petitioner by an order of this Court, dated 08.05.2024 in Crl.O.P.No.11092 of 2024 that "the petitioner without prejudice to his defence shall deposit a non-refundable sum of Rs.5,000/- by way of Demand Draft to the District Revenue Officer, Cuddalore and that the receipt of such payment shall be produced before the concerned Magistrate at the time of executing the bond".

The learned counsel for the petitioner submits that he was enquired with the District Revenue Officer, Cuddalore for depositing the said condition amount, he informed that there is no bank account in the name of District Revenue Officer and therefore, he could not deposit the said amount and he is also unable to execute the surety before the learned Magistrate. He further submits that the petitioner is residing in Cheyyar, within the District of Tiruvannamalai. 3. The learned Government Advocate (Crl.Side) appearing for the respondent has no objection.

Considering the submission made by the learned counsel on both sides, the condition imposed as against the petitioner is modified that "the petitioner without prejudice to his defence shall deposit a nonrefundable sum of Rs.5,000/- [Rupees Five Thousand only] to the credit of Registered Advocate Clerks Welfare Association, Tiruvannamalai, and that the receipt of such payment shall be produced before the concerned Magistrate at the time of executing the bond".
