This writ petition has been filed challenging the impugned rejection order passed by the respondent dated 31.07.2023 and for a consequential direction to the respondent to issue patta based on the Lok Adalat Award passed in O.S.No.241 of 2007 on the file of District Munsif Court, Arakkonam.
2. Heard Mr.P.Krishnan, learned counsel for petitioner and Mr.P.Sathish, learned Additional Government Pleader appearing for respondent.
3. The impugned online rejection order has been issued by the respondent stating that the property has been categorised as a Panjami land reserved for persons belonging to SC/ST community.
4. The petitioner claims that he also belongs to the scheduled caste community and the petitioner is also relying upon the award passed in the Lok Adalat in a suit filed in O.S.No.241 of 2007. In view of the same, the respondent ought to have provided opportunity to the petitioner and called for enquiry and thereafter, passed a reasoned order. Since the 2/4
order is bereft of details, the same is liable to be interfered with by this Court. Accordingly, the impugned online rejection order dated 31.07.2023 passed by the respondent is hereby quashed. There shall be a direction to the respondent to deal with the application submitted by the petitioner and pass orders within a period of four (4) weeks from the date of receipt of a copy of this order.
