Respondent PRAYER: Criminal Revision Case filed under Sections 438 and 442 of BNSS, 2023, praying to set aside the order dated 10.12.2024 passed by the Judicial Magistrate, Thiruthuraipoondi in CMP.No.5457 of 2024 and consequentially direct the respondent to conduct proper enquiry and take appropriate action on the petitioner's complaint dated 17.04.2024 and 24.05.2024.

ORDER

This criminal revision case has been preferred against the

order dated 10.12.2024 passed by the Judicial Magistrate, Thiruthuraipoondi in CMP.No.5457 of 2024, thereby dismissing the petition filed under Section 175(3) of BNSS for seeking direction to register FIR.

The learned counsel for the petitioner would submit that the aforesaid petition was dismissed only on the ground that the petitioner failed to lodge any complaint before the jurisdictional police. 3.

Heard, the learned counsel appearing on either side and perused, all the materials placed before this Court. 4.

On perusal of the complaint lodged by the petitioner, it is revealed that there was a group clash, for which a criminal case has been registered against the petitioner. However, also the petitioner lodged a complaint and the same was enquired and closed. Therefore, no prima facie case is made out to register any FIR. Hence, this Court finds no infirmity or illegality in the impugned order and this criminal revision case is liable to be dismissed.

In view of the above discussion, this criminal revision case is dismissed.
